  1.                 LICENSE AGREEMENT
  2.  
  3. This is an agreement between _______________________________________,
  4. hereafter Licensee, and Ralf Brown, hereafter Author, regarding a
  5. nonexclusive license to use the source code to the product known as
  6. SPAWNO.  Unless otherwise noted, the term "Source Code" shall refer to
  7. those portions of the complete source code which are not included in
  8. the public distribution of SPAWNO; all files which fall into this
  9. category are marked with the Licensee's name and a unique serial number.
  10.  
  11. The Licensee agrees to abide by the following terms and conditions
  12. upon the use of the Source Code:
  13.  
  14.  1. The Source Code is licensed to the Licensee and neither the Source
  15.     Code nor any derivatives may be redistributed or transferred without
  16.     prior written permission.  The sole exception shall be distribution
  17.     to multiple programmers actively working on the development of a
  18.     single product.
  19.  
  20.  2. Object code created from the Source Code or derivatives of the
  21.     Source Code may be incorporated into the Licensee's own works and
  22.     distributed provided that
  23.        a) the embedded copyright notice is not altered or removed; the
  24.       addition of the Licensee's own copyright notice is permitted.
  25.        b) such inclusion is acknowledged in the documentation; a
  26.       statement similar to the following is sufficient:
  27.          "This program uses a customized version of Ralf Brown's
  28.           SPAWNO routines to minimize memory use while running
  29.           other programs or shelling to DOS."

  31.  3. Object code created from the Source Code, or any derivatives
  32.     thereof, which is not incorporated into the Licensee's own works
  33.     may be distributed provided that
  34.        a) the embedded copyright notice is not altered or removed; the
  35.       addition of the Licensee's own copyright notice is permitted.
  36.        b) the complete original publicly-available version of
  37.       SPAWNO is included in said distribution.

  39.  4. The Licensee agrees to abide by the distribution restrictions on any
  40.     pre-release ("beta") software which may accompany the Source Code.
  41.  
  42.  5. The Licensee acknowledges that the Source Code (both public and
  43.     licensed portions) and any pre-release software are provided AS IS
  44.     with no warrantees, express or implied, including (but not limited
  45.     to) correctness, merchantability, or fitness for use.  The Author
  46.     disclaims all liability for damages, both consequential and
  47.     incidental, resulting from the use or misuse of the SPAWNO package
  48.     or pre-release software. Sole responsibility for determining the
  49.     fitness of SPAWNO for a particular use rests with the Licensee.

  52. source code.
